1. Introduction and Acceptance
1.1. These Terms and Conditions of Sale (“Terms”) govern the sale of products (“Products”) and services (“Services”), including online courses and webinars (“Courses”), by Art For Awakening S.R.L. (“we,” “us,” “our,” or the “Seller”), a Romanian legal entity with its headquarters at Frumuseni Commune no. 276, Arad County, Romania, registered with the Arad Trade Register under no. J2/1230/2022, Unique Registration Code 46432333, VAT ID RO47759873. Subscribed and paid-up capital in the amount of 1,000 lei.
1.2. The Seller operates the e-commerce website www.f-aurea.com (“the Site” or “F-Aurea.com”). Our customer service (“Customer Support”) is available via email at info@f-aurea.com and by phone at (+39) 3494279469. Please note that this is an Italian phone number, and call charges may apply depending on your location and plan.

2. Definitions
Consumer: A natural person who is acting for purposes which are outside their trade, business, craft, or profession.
Order: Your offer to purchase Products or Services from us, submitted electronically via the Site.
Contract: The legally binding agreement for the sale of Products or Services formed when we accept your Order.
Account: The personal section of the Site created by you, allowing you to manage your data, orders, and access digital Services.

3. Product and Service Information
3.1. The images and descriptions of Products on the Site are for illustrative purposes only. While we make every effort to display attributes accurately, slight variations may occur.
3.2. Nature of Courses and Services: The Courses, webinars, and related materials provided by F-Aurea.com are educational in nature and are focused on philosophy, personal wellness, and meditation practices. They are based on the research and philosophies of Francesco Verticchio, Manlio di Donato, Elisa Pontarini, and the F-Aurea Research Group.
3.3. Not Medical or Therapeutic Advice: OUR COURSES, WEBINARS, AND RELATED MATERIALS ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHIATRIC, OR PSYCHOTHERAPEUTIC ADVICE, DIAGNOSIS, OR TREATMENT. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or mental health condition. The Seller is not responsible for any decisions made or actions taken based on the content of the Courses.

4. Ordering and Contract Formation
4.1. To place an Order, you must add the desired Products/Services to your shopping cart and proceed through the checkout process, providing accurate and complete information.
4.2. Your Order represents an offer to purchase. Our confirmation of receipt of your Order is an acknowledgment, not an acceptance. The Contract is formed only when we send you a separate order confirmation email, explicitly confirming the availability and shipment of the Product or the activation of the Service.
4.3. We reserve the right to refuse or cancel an Order in case of errors in product information, pricing, availability, or suspected fraudulent activity.

5. Prices and Payment
5.1. All prices on the Site are displayed in EURO and include Value Added Tax (VAT) where applicable.
5.2. Accepted payment methods are listed at checkout (e.g., credit card, bank transfer). Payment processing for cards is handled by our partner, Banca Transilvania S.A. Your payment details are secured by the payment processor and are not stored on our servers.
5.3. For bank transfers, the Order will be processed only after we have confirmed receipt of the full payment.

6. Delivery of Physical Products
6.1. We ship physical Products to addresses within Europe. For deliveries outside Europe, please contact us at info@f-aurea.com prior to ordering.
6.2. Shipping costs will be clearly displayed at checkout before you finalize your Order.
6.3. The estimated delivery time is provided during checkout. While we strive to meet these estimates, delivery times are not guaranteed. We are not liable for delays caused by the courier or force majeure events.
6.4. Upon delivery, you are responsible for inspecting the Products for any obvious damage. Any issues should be immediately noted on the courier’s delivery document.

7. Access to Digital Services (Courses & Webinars)
7.1. Upon our acceptance of your Order and confirmation of payment, we will grant you access to the purchased Course or webinar via your Account or via a link sent by email.
7.2. You agree that upon access to the digital content (e.g., video files, PDFs), you will lose your right of withdrawal, as the performance of the service has begun with your prior explicit consent.
7.3. You receive a limited, non-exclusive, non-transferable license to use the course materials for your personal use only. You are not permitted to reproduce, redistribute, sell, or share the materials.

8. Right of Withdrawal for Consumers (Physical Products)
8.1. If you are a Consumer, you have the right to withdraw from the Contract for physical Products within 14 calendar days from the day you receive the Products, without giving any reason. Consumers purchasing from within Romania, are entitled to a 30-day withdrawal period in accordance with Romanian law.
8.2. To exercise your right of withdrawal, you must inform us of your decision by sending an unambiguous statement to info@f-aurea.com. You may use the model withdrawal form available on the Site.
8.3. You must return the Products to us at your own cost, without undue delay and in any event not later than 14 days from the day you communicated your withdrawal. The Products must be returned in their original condition, unused, and with all packaging. Consumers purchasing from within Romania, are entitled to a 30-day withdrawal period in accordance with Romanian law.
8.4. We will reimburse all payments received from you, including standard delivery costs, within 14 days from the day we receive the Products back. We may withhold reimbursement until we have received the Products or until you have supplied evidence of having sent them back, whichever is the earliest. Consumers purchasing from within Romania, are entitled to a 30-day withdrawal period in accordance with Romanian law.
8.5. Exceptions to the Right of Withdrawal: The right of withdrawal does not apply to:
* Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., cosmetics, massage oils, herbal supplements).
* Products made to your specifications or clearly personalized.

9. Warranty and Complaints
9.1. Physical Products are covered by the legal guarantee of conformity provided by Romanian law, which applies for two years from delivery. This guarantee entitles you to repair, replacement, price reduction, or contract termination if a Product is not in conformity with the Contract.
9.2. For any complaints regarding Products or Services, please contact us at info@f-aurea.com, providing your Order details and a description of the issue. We will respond to your complaint promptly and in any case within the legal deadlines.

10. Intellectual Property
10.1. All content on the Site, including trademarks, logos, text, graphics, video, and audio materials from the Courses, is the intellectual property of Art For Awakening S.R.L. or its licensors and is protected by copyright laws.
10.2. You may not use, copy, reproduce, distribute, or exploit any of our intellectual property for commercial purposes without our prior written consent.

11. Limitation of Liability
11.1. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.
11.2. Subject to the above, our total liability to you, whether in contract, tort (including negligence), or otherwise, shall be limited to the total price of the Products or Services you purchased in the Order giving rise to the liability.
11.3. We are not responsible for any indirect or consequential losses that were not foreseeable to both you and us at the time the Contract was formed.

12. Applicable Law and Dispute Resolution
12.1. These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of Romania.
12.2. If you are a Consumer, you may bring any judicial proceedings relating to these Terms in the courts of your country of residence. We will bring proceedings in Romania. The European Commission’s Online Dispute Resolution platform (http://ec.europa.eu/consumers/odr/) is also available for Consumers.

13. Final Provisions
13.1. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
13.2. Our failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.
