1 GENERIC TERMS AND CONDITIONS

1. The online store available at the internet address www.f-aurea.com (“f-aurea.com”) is owned and managed by the company Art For Awakening s.r.l., a legal entity under Romanian law, with headquarters in Frumuseni Commune no. 276, Arad County, tel.: (+39) 3494279469, e-mail: info@f-aurea.com, registered in the Arad Trade Register under no. J2/1230/2022, Unique Registration Code 46432333, subscribed and paid-up capital in the amount of 1,000 lei (“Art For Awakening”, “The Company” or “The Seller”).

2. The use of f-aurea.com requires the IT systems used by the Customer to meet certain technical requirements.

3. The Terms and Conditions of f-aurea.com are addressed to Users, Consumer, Customers and Non-Consumer Customers who browse f-aurea.com, or buy the service provided.
4. The information presented on f-aurea.com regarding the Products constitutes only the invitation to conclude the Sales Contract within the meaning of art. 2 point 5 of the Government Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts.
6. Acceptance of the f-aurea.com Terms and Conditions is voluntary, but necessary for the creation of the Account and/or for the purpose of placing the order by the Customer or User, representing a formality preceding the conclusion of the Distance Contract.
7. Browsing within f-aurea.com, followed by the Order, is equivalent to the reading, understanding and express acceptance by any Customer or User of the f-aurea.com Terms and Conditions.
8. Arto For Awakening s.r.l. reserves the right to change and update, at any time, the content of the f-aurea.com platform, as well as the Terms and Conditions of Use, without any prior notification. In case of divergence or misunderstandings between the Company and the Client/User, the Terms and Conditions valid at the time of placing the Order by the Client/User will apply.
9. The f-aurea.com Terms and Conditions are primarily intended for the purchase of Products through the f-aurea.com platform, but may also apply, as the case may be, to the purchase of Products from the Company’s physical stores.
10. The products are delivered by the Company in usual quantities for domestic consumption. Art For Awakening s.r.l. reserves the right to set the maximum amount of Products that it can provide to the Client and/or User,
11. All information used to describe the Products available on f-aurea.com (i.e. static/dynamic images/multimedia presentations, etc.) do not represent a contractual obligation on the part of the Seller, they are used within f-aurea.com exclusively as presentation.
12. If the payment of the Product Price is made online, the Company is not/cannot be held responsible for any other additional costs incurred by the Client/User, including but not limited to currency conversion fees applied by the issuing bank the bank card of the Client/User, if the currency of its issuance is not in EURO.
13. The Seller may assign and/or subcontract to a third party services related to the fulfillment of the Order, with the information of the Client/User, without his consent being necessary. In all cases, Art For Awakening s.r.l. will be liable to the Client/User for all contractual obligations assumed under the Distance Contract.

16. If the www.f-aurea.com platform is affected by an unusually high volume of traffic, the Company reserves the right to ask the Clients/Users to manually enter captcha validation codes, in order to protect the information from the f-aurea.com framework
17. Creating multiple Accounts, using automatically generated addresses that expire after a predefined period, in order to benefit from promotions or offers, or any fraudulent behavior to the extent of affecting the smooth running of the Promotional Campaigns (i.e. placing Orders in an amount substantially, for the purpose of accumulating some loyalty points, but which are canceled later) is prohibited and will be considered an attempt at fraud. Art For Awakening reserves the right to suspend the Accounts so created and to withdraw the benefits of the Promotional Campaigns or ongoing offers, to cancel the Account without notice, notice, other formalities or compensation.
18. Any attempted fraud or any fraud (such as, but not limited to accessing the data of Customers and/or Users of f-aurea.com and/or the Application, altering the content of the www.f-aurea.com platform, attempting affecting the performance of the servers that serve the www.f-aurea.com platform, diversion of the content of Product deliveries to third parties, etc.) will be punished according to the legal provisions in force.

2 SHOP TERMS AND CONDITIONS

2.1. THE CUSTOMER ACCOUNT ON THE F-AUREA.COM SHOP PLATFORM
In order to be able to order the products sold on the f-aurea.com SHOP Platform, it is necessary to create a customer account.
To be able to place an order on the F-AUREA SHOP Platform, you must follow the following steps, namely: choosing the desired product or service, followed by the “Add to basket” option. When adding the selected products to the basket, you will be automatically directed to the shopping basket page, where you can review the list of products, update the quantity or cancel one or all of the selected products. To add more products to the basket, you can return to the F-AUREA SHOP Platform.
2.2. DELIVERY TERMS AND STOCKS
The products listed on the F-Aurea.com Shop and sold through the Platform will contain all the necessary information regarding the stock in real time as well as the estimated delivery time for each location in the world.
2.3. PAYMENT
The products listed by the Merchants on the f-aurea.com SHOP Platform can be paid for by the following payment methods: a) Credit Card. b) Bank transfer. For the ordered products, you will receive tax invoices.

2.4. WARRANTIES AND RETURNS
In the case of products that benefit from a warranty, you will receive a warranty certificate upon delivery with all the details of the service center that provides repairs during the warranty period.
Art For Awakening has the legal obligation to accept the return of products within 14 days from the time of delivery.

3 COURSES TERMS AND CONDITIONS

3.1. EDUCATIONAL PHILOSOPHICAL AND WELNESS NATURE

1. Customer agree that the courses and online webinars is in the nature of education, philosophy and wellness.

2. The scope of services rendered by Art For Awakening s.r.l. pursuant to this contract shall be solely limited to those contained therein and provided for on f-aurea.com. Art For Awakening reserves the right to substitute services equal to or comparable to the Courses for Client if the need arises.

3.2. NO SUBSTITUTE FOR MEDICAL AND\OR PSYCHOTERAPICAL TREATMENT.

1. Art For Awakening s.r.l. and the books, classes, webinars, tools, and others products or service selled throught f-aurea.com do not teach or educate in medical practices, healing practices, psychotherapy practices, or otherwise kinds of treatment that falls under the medical and psychotherapical care.

2. F-Aurea.com does not provide medical, therapy, or psychotherapy services.

3. Customer agrees to be mindful of his/her own wellbeing during the course and online webinars and seek medical treatment (including, but not limited to psychotherapy), if needed. Art For Awakening s.r.l. is not responsible for any decisions made by Client as a result of the coaching and any consequences thereof.

3.3. NATURE OF THE COURSES AND ONLINE WEBINARS.

1. The Courses, and online webinars are inherent in meditation, and may contains praying pratices, yoga practices, breathing practices, theurgic practices, and constitutes a realised inspirational philosophy to the F-Aurea and meditative practice paradigm toward welness.

2. The concepts carried in all the aforementioned courses and online webinars are the result of the autonomous research by Francesco Verticchio, Manlio di Donato, Elisa Pontarini and the F-Aurea Research Group.

3. The courses and online webinars respect every belief and personal ideas of each, even when we do not share them; We abstain from judging and criticising and discriminating. Every statement in these directions should be considered a personal idea not inherent in the courses or online webinars.

3.4. NO RESALE OF SERVICES PERMITTED.

Customers agrees not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Courses or Online Webinars (including courses materials). This agreement is not transferrable or assignable with Art For Awakening s.r.l. without Art For Awakening s.r.l. prior written consent.
3.5. NO TRANSFER OF INTELLECTUAL PROPERTY OF NAMES VIDEOS AND MATERIAL OF COURSES AND ONLINE WEBINARS.

1. Art For Awakening s.r.l. copyrighted and original materials provided to the customers thorught the courses and online webinars purchased from f-aurea,com shop shall be provided to the Customer for his/her individual use only and a single-user license.

2. Client shall not be authorized to use any of Art For Awakening s.r.l. intellectual property for Customer business purposes. Customer shall not be authorized to share, copy, distribute, or otherwise disseminate any materials received from Art For Awakening s.r.l. electronically or otherwise without the prior written consent of Art For Awakening s.r.l. All intellectual property, including Art For Awakening s.r.l. copyrighted course materials, shall remain the sole property of Art For Awakening s.r.l. No license to sell or distribute Company’s materials is granted or implied. This includes but is not limited to the terms: Ignis Rebirth, F-Aurea, F-Aurea Group, F-Aurea.com, F-Aurea Holfrattale etheric information field, F-Aurea informational field, Ricalibrazione Planetaria, Planet Recalibration Practice, F-Aurea Fields, F-Aurea Etheric Fields, F-Aurea Tradiction, F-Aurea Etheric Forces.

This does not include concepts and ideas, but only material documents, and program videos.

3.6. NON COMMERCIAL RIGHTS TO SHARING IDEAS AND PARADIGMS

1 The concepts and ideas shared throght f-aurea.com, books, classes and online webinars, selled on f-aurea.com shop, or otherwise present in f-aurea.com website are to be considered a heritage of humanity, and falls under Creative Commons License 4.0. Attribution-NonCommercial 4.0 International (“CC BY-NC 4.0”). This not cover the phisical material such as videos, PDF, books and ebooks, but cover only the ideas, paradigms, and other philosophical aspects found on those materials.

2. Creative Commons License 4.0. (“CC BY-NC 4.0”) cover only the ideas and the concepts shared on f-aurea.com platform, books or ebooks sold at f-aurea.com shop, courses and online webinars purchased thorught f-aurea.com shop, and every material from the F-Aurea Group.

3. Creative Commons License 4.0. (“CC BY-NC 4.0”) permit the Customer at his\her own sole risk and responsability to share the IDEAS and PARADIGMS, and remix or include them in others works and classes, under the following terms: a) Attribution. Customer must give appropriate credit, provide a link to the license, and indicate if changes were made citing the source of the informations shared as F-Aurea.com or F-Aurea Group and Francesco Verticchio, Manlio Di Donato. Customer may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use. b) NonCommercial: Customer may not use the material for commercial purposes. c) No additional restrictions: Customer may not apply legal terms or technological measures that legally restrict others from doing anything the license permits. d) Accountability: The Customer will be the sole and only one accountable for damage that may be provided by the shared ideas.

3.7. LIMITATION OF LIABILITY.

By using Art For Awakening s.r.l. services buying courses and or online webinars, ebooks, books, and other materials, Customer releases Art For Awakening s.r.l. it officers, employers, directors, and related entities from any and all damages that may result from anything and everything. Courses and online webinars are only an educational/coaching service being provided. By using Art For Awakening s.r.l. services and enrolling in the Courses and Online Webinars found on f-aurea.com, Customer releases Company from any and all damages that may result from anything and everything. Customer accepts any and all risks, foreseeable or non foreseeable, arising from such transactions. Regardless of the previous paragraph, if Art For Awakening s.r.l. is found to be liable, Art For Awakening s.r.l. liability to Client or to any third party is limited to the lesser of (a) the total fees Customer paid to Art For Awakening s.r.l. in the one month prior to the action giving rise to the liability, and (b) € 1000. All claims against Art For Awakening s.r.l. must be lodged with the entity having jurisdiction within 100-day of the date of the first claim or otherwise be forfeited forever. Customer agrees that Art For Awakening s.r.l. will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Art For Awakening s.r.l. services or enrolment in the Courses and or Online Webinars. Customer agrees that use of Art For Awakening s.r.l. services is at Client’s own risk.

3.8. DISCLAIMER OF GUARANTEE.

Customer accepts and agrees that she/he is 100% responsible for her/his progress and results from the Courses and Online Webinars. Customer accepts and agrees that she/he is the one vital element to the Course and or Online Webinar success and that Art For Awakening s.r.l. cannot control Customer. Art For Awakening s.r.l. makes no representations or guarantees verbally or in writing regarding performance of this Agreement other than those specifically enumerated herein. Art For Awakening s.r.l. and its affiliates disclaim the implied warranties of titles, merchant ability, and fitness for a particular purpose. Art For Awakening s.r.l. makes no guarantee or warranty that the courses or online webinars will meet Customer requirements or that all customers will achieve the same results.
3.9. COURSE RULES.

1. To the extent that Customer interacts with Art For Awakening s.r.l. staff and/or other Art For Awakening s.r.l. Customers, Customer agrees to at all times behave professionally, courteously, and respectfully with staff and customers.

2. Customer agrees to abide by any Course Rules/Regulations presented by Art For Awakening s.r.l. The failure to abide by course rules shall be cause for termination of this Agreement. In the event of such termination, Customer shall not be entitled to recoup any amounts paid and shall remain responsible for all outstanding amounts of the Fee.
3.10. USE OF COURSE MATERIALS.

Customer consents to recordings being made of courses on online webinars. Art For Awakening s.r.l. reserves the right to use, at its sole discretion, course and online webinars materials, videos and audio recordings of courses, and materials submitted by Customer in the context of the course(s) and online webinars for future lecture, teaching, and marketing materials, and further other goods/services provided by Art For Awakening s.r.l., without compensation to the Customer. Customer consents to its name, voice, and likeness being used by Art For Awakening s.r.l. for future lecture, teaching, and marketing materials, and further other goods/services provided by Art For Awakening s.r.l., without compensation to the Customer.
3.11. TERMINATION.

In the event that Customer is in arrears of payment or otherwise in default of this Agreement, all payments due here under shall be immediately due and payable. Art For Awakening s.r.l. shall be allowed to immediately collect all sums from Customer and terminate providing further services to Customer. In the event that Customer is in arrears of payments to Art For Awakening s.r.l., Customer shall be barred from using any of Art For Awakening s.r.l. services.
3.12. CONFIDENTIALITY.

The term “Confidential Information” shall mean information which is not generally known to the public relating to the Customer business or personal affairs. Art For Awakening s.r.l. agrees not to disclose, reveal or make use of any Confidential Information learned of through its transactions with Customer, during discussion with Customer, the coaching session with Art For Awakening s.r.l., or otherwise, without the written consent of Customer. Art For Awakening s.r.l. shall keep the Confidential Information of the Customer in strictest confidence and shall use its best efforts to safeguard the Customer Confidential Information and to protect it against disclosure, misuse, espionage, loss and theft.

4 DEFINITIONS

1. The definitions below shall apply to the following terms when used in this material, unless the context otherwise requires:
Promotional Campaigns
The particular sales conditions of the Products displayed within f-aurea.com, regulated by related regulations, in compliance with Incidental Legislation (i.e. reduction of the Price or delivery costs, within the limits of available stocks, etc.);
Technical Requirements
Minimum technical requirements whose fulfillment is necessary for the use of f-aurea.com, namely a computer, laptop, mobile devices, or other multimedia device with internet access, such as to ensure access to e-mail and the internet.
Client, Customer, User
Any natural person who is at least 18 years old or legal person who visits f-aurea.com and/or places an Order based on an Account;

Command
An electronic document that intervenes as a form of communication between the Seller and the Customer/User, through which the Customer/User expresses his intention to conclude a Distance Contract, using the means of distance communication, specifying at the same time the Products that he offers to purchase from the Seller and providing him with the necessary data for the conclusion and execution of the Distance Contract;
Commercial Communications
The “newsletter” electronic service that allows Customers or Users to receive periodic information from the Seller, in particular about Promotional Campaigns and Products offered for sale within f-aurea.com, to the e-mail address or phone number that The Customer and/or User provided them in the Account creation process;
Consumer
Any natural person or group of natural persons constituted in associations, who act for purposes outside their commercial, industrial or production, craft or liberal activity;
Account
The electronic service made available to the Customer by f-aurea.com, identified by email address (Login) and Password, entered by the Customer, resources collected by the Seller’s computer system and which allows the Customer to use additional functionalities/services (i.e. viewing orders , tax invoices, etc.);
Distance contract
Sale-purchase contract concluded at a distance, without the simultaneous physical presence of the Seller and the Customer/User, materialized in the order confirmed and accepted by the Seller, by email and through which the Seller agrees to sell and deliver the Products, and the Customer /The User agrees to purchase, receive and pay for these Products, in accordance with the principles established by the Terms and Conditions of f-aurea.com;
Content
Text, graphics or multimedia elements such as, but not limited to, information about the Products and including images and descriptions thereof, promotional videos, if applicable, descriptions and images of people, scripts, software, trademarks , which are posted and distributed within f-aurea.com by the Seller, being the property of the Seller or its suppliers;
Shopping Basket
The service that the Seller offers to each Customer or User of f-aurea.com and which allows placing the Order for one or more Products, entering discount codes that facilitate the reduction of the Price under the conditions of certain Promotional Campaigns, viewing the Price of each individual Product and of all the Products together, of any costs related to the delivery of the Products and the estimated date of their delivery. The Shopping Basket collects the offers submitted by the Customer or User for the conclusion of the Distance Contract. By means of an Order, the Customer or User can add more Products to the Shopping Cart in order to conclude the Distance Contract;
Courier
Any person under public or private law that provides express courier services;
CS Department
The Customer Support Department (customer relations) and which provides Customers or Users with information on the activity carried out through f-aurea.com, being available (i) at the email address info@f-aurea.com; and (ii) at telephone number (+39) 3494279469 from Monday to Friday, between 10:00 – 12:00 and 15:00 – 17:00 the call is handled by one of our representatives in Italy and may be subject to additional charges for calls made outside Italy and outside the European community.

F-aurea.com
The online service provider and store which consists of the commerce platform www.f-aurea.com and which allows placing Orders by the Customer or User, as well as the provision of services provided by the Seller. f-aurea.com. is owned, operated and managed by the Seller, being made up of a set of interrelated internet pages, which can be accessed both through a web browser and through the Application;
Incidental Legislation
The Civil Code of 2009, Government Ordinance no. 99/2000 regarding the sale of products and services on the market, Law no. 193/2000 regarding abusive clauses in contracts concluded between professionals and consumers, Law no. 356/2002 regarding electronic commerce, Government Decision no. 1308/2002 regarding the approval of methodological norms for the application of Law no. 356/2002 regarding electronic commerce, Law no. 449/2003 regarding the sale of products and their associated guarantees, Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector, Government Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals and for the modification and completion of some normative acts;
Log in
The Customer’s e-mail address and password provided within f-aurea.com during the Account creation process;
Password
An alphanumeric string required to authorize access to the Account, which is established by the Customer during the Account creation process.
Price
The amount of money that the Seller receives in exchange for providing the Customer/User with the ordered Product, in accordance with the terms and conditions of the Distance Contract. The price consists of the value of the Product, to which are added, as the case may be, the related transport and/or collection costs. The related transport and/or collection costs are detailed on www.f-aurea.com, before placing the Order by the Customer and/or User, but also below, in the “Delivery” section;
Product
The asset listed on f-aurea.com, mentioned in the Order and which is the object of the Distance Contract, to be provided by the Seller to the Client or User, in exchange for payment of the Price;

f-aurea.com Terms and Conditions
This document, which defines the terms for concluding Distance Contracts through F-Aurea.com and the Application, establishes the rights and obligations of the Seller and the Client/User, in accordance with the provisions of the Incidental Legislation;
Transaction
The operation of collection or reimbursement to the Customer/User of the amount resulting from the sale of a Product by f-aurea.com, by using the services of the card processor agreed by the Seller or by bank transfer by payment order, regardless of the delivery method chosen by the Client/User.
User
Any natural person over the age of 18 or legal entity who visits f-aurea.com and/or places an Order, without having created a Customer Account
Working day
One of the days from Monday to Friday inclusive, with the exception of public holidays, declared days off.
Banca Transilvania
It is a credit institution headquartered in Cluj-Napoca, Romania.

5. ELECTRONIC SERVICES AND FUNCTIONALITIES MADE AVAILABLE TO THE CUSTOMER AND/OR USER BY THE SELLER WITHIN THE F-AUREA:COM. COMMERCIAL COMMUNICATIONS

1. Within f-aurea.com, the Seller provides the Customer and/or the User with the following electronic services and functionalities:
1.1. creating the Account;
1.2. using the Shopping Basket;
1.3. placing Orders, as well as concluding Distance Contracts, under the conditions regulated by the f-aurea.com Terms and Conditions;
1.4. viewing the Content displayed within f-aurea.com;
1.5. the transmission of Commercial Communications, based on the prior consent expressed by the Client;

2. The Seller, in addition to Customers who already have an Account, offers free storage and making available to them through the Account the history of Orders, the tax invoices related to the purchased Products, the possibility of updating the contact, delivery and payment data, as the case may be, etc.

3. The use of the Account is possible after the Customer completes the following steps: filling out the registration form, understanding and accepting the provisions of the f-aurea.com Terms and Conditions, and by pressing the “Create account” button.

4. The Shopping Basket is offered free of charge, has a singular character and ends when the Order is placed through it or when the Customer/User does not complete the Order through it, and the Shopping Basket saves the information selected by the Customer and after the end of the browser session, including logging out, but not reserving the Products.

5. The Customer and/or the User have the following obligations regarding the use of the electronic services and functionalities made available by the Seller within the F-AUREA.COM SHOP:

6. The Client and/or the User have the following obligations regarding the use of the electronic services and functionalities made available by the Seller within f-aurea.com:
6.1. to provide truthful data when placing an Order or in the registration forms when creating the Account;
6.2. to update the data they provided to the Seller at the time of placing the Order and concluding the Distance Contract, especially for the correct use of the electronic services and functionalities offered by f-aurea.com. The Customer/User has the possibility to change at any time the data entered during the creation of the Account or the placing of the Order, using all the options available in the section of the Account or placing the Order;
6.3. to use the electronic services and functionalities made available by the Seller so as not to interfere with the operation of the www.f-aurea.com platform;
6.4. to use the services and functionalities made available by the Seller in accordance with the legislation in force and with the Terms and Conditions of f-aurea.com;
6.5. to pay on time the Price and other costs associated with the delivery of the Products, as the case may be;
6.6. not to carry out IT activities or any other activities aimed at obtaining information that is not intended for the Client and/or User, including data of other Clients or that interfere with the principles or technical aspects of the operation of f-aurea.com and making the payment of the Price of the Products, or the unauthorized modification of the Content provided by the Seller, especially those provided within f-aurea.com regarding the Prices or the description of the Products;

6.7. Complaints regarding the provision of electronic services within f-aurea.com can be submitted:
6.7.1. in writing to the address: Frumuseni Village, Frumuseni Commune, No. 276, Arad County.
6.7.2. in electronic format via e-mail to the address: info@f-aurea.com

6.8. It is recommended that the Customer/User specify the following aspects in the claim/complaint:
6.8.1. the nature and circumstances related to the subject of the complaint, in particular, the type of irregularity and the date when it occurred;
6.8.2. the request of the Client or the User;
6.8.3. contact details of the petitioner.

! The requirements listed above are only a model and do not affect the effectiveness of submitted complaints if the recommended model is omitted, but this information may facilitate the speedy examination of the complaint by the Seller.
The resolution of the complaint by the Seller can be done immediately, but not later than 30 calendar days from the date of confirmation of receipt of the complaint formulated by the Customer/User.

5.2 COMMERCIAL COMMUNICATIONS
1. The Customer can at any time change his option regarding the agreement given to the Seller for Commercial Communications containing general and thematic information regarding the Products offered within f-aurea.com, including regarding offers or promotions, as follows:
a. by changing the Account settings in the “Account Settings” section;
b. by accessing the unsubscribe link displayed in the Commercial Communications received from the Seller;
2. The messages received by the Customer/User from the Seller, via SMS or e-mail, regarding the status of the relationship between the Seller and the Customer/User (i.e. account creation confirmation, Order placement confirmation, Product delivery notification, communication of security incidents, etc.).

5.3 PERSONAL DATA PROCESSING
1. Art For Awakening s.r.l. collects and processes personal data within the www.f-aurea.com platform according to the Policy regarding the Processing of Personal Data in f-aurea.com, available here.
2. Consent for receiving Commercial Communications is expressed by the Customer and/or User according to the Policy on the Processing of Personal Data, available on www.f-aurea.com. Details regarding the processing of data for the purpose of sending Commercial Communications regarding the Products, including the conditions for unsubscribing, can be found in the Policy regarding the Processing of Personal Data in f-aurea.com, available here.

5.4 REGISTRATION OF A CUSTOMER ACCOUNT. PLACING THE ORDER. CONCLUSION OF THE DISTANCE CONTRACT
1. To create an account on the www.f-aurea.com platform, the potential client is required to use a valid e-mail address and follow the steps described in the Account creation page, available at www.f-aurea. com.
2. Account registration requires repeating the Password twice to detect and correct typos.
3. The customer obtains access to the Account with the help of the Login and Password. The customer logs into his Account after registering in f-aurea.com. The account allows the storage of information related to the address provided by the Customer for the Products ordered, the status and history of the Orders, the tax invoices issued by the Seller, as well as accessing other services provided by the Company, such as downloading online courses and participating in the webinar.
4. The Customer is obliged to keep the Password in complete confidentiality, not to disclose it to third parties and understands that if he entrusts the Account Password to someone, that person will have access to his personal data, and Art For Awakening will thus be exempted from any liability which would derive from an unauthorized use of the Account.
5. The Seller offers the Customer the opportunity to change his Password at any time.
6. Art For Awakening s.r.l. may refuse the request to register an Account if Art For Awakening s.r.l. finds that untrue information was used in the process of creating the Account.
7. The Customer has the possibility, at any time and without reason, to delete the Account (cancellation of the Account), either directly from the Account, or by sending a request to the address info@f-aurea.com.

5.5. PLACING THE ORDER

5.5.1 General aspects

1. The Seller offers the possibility of placing the Order for Products by accessing the www.f-aurea.com platform;
2. The products purchased through f-aurea.com are intended exclusively for the personal use of the Customer and/or User.
3. f-aurea.com cannot be held responsible for information entered erroneously by the Customer and/or User, which may result in delays or impossibility of delivery. At the same time, in this case, Art For Awakening s.r.l. cannot be held responsible for any possible damage suffered by the Client and/or User as a result of the delay in the delivery of the Order.
4. f-aurea.com may refuse an Order, subject to prior notification to the Customer and/or User, without any obligations between the parties and without the possibility for the Customer and/or User to claim damages, in any of the following situations:

a. failure / invalidation of the Transaction;
b. non-acceptance by the issuing bank of the card of the Client/User of the Transaction, carried out by bank transfer;
c. incomplete or incorrect data provided by the Client and/or User;
d. the activity of the Client and/or the User may cause damage to the www.f-aurea.com platform and/or to the Company’s commercial partners;
e. there are reasonable suspicions that the respective Customer/User places Orders exclusively in order to accumulate the benefits offered by f-aurea.com (i.e. does not honor the Orders later, canceling them or not paying the Price of the Products);
f. there are reasonable suspicions regarding possible fraud on the part of the Customer or the User regarding the method of payment of the Price of the Products.

5. Even if he has taken all measures to ensure that the information presented on the www.f-aurea.com platform is accurate and correct, the Seller cannot be held responsible for inaccuracies that may appear when the Customer and/or User completes the forms in the www.f-aurea.com platform to complete the Order. The Client and/or User are responsible for the correctness and completeness of the information they provide in the forms available on the www.f-aurea.com platform
6. In certain situations and for justified reasons, Art For Awakening s.r.l. reserves the right to change the quantity of Products in the Order. In these situations, the Clients/Users will be notified via e-mail, and Art For Awakening s.r.l. will return the amount paid by the Client or User, if the counter value of the Products was previously paid by the Client or User.
7. In the event that a Product ordered by the Customer/User can no longer be delivered/supplied by Art For Awakening s.r.l., we undertake to inform the Customer/User of this fact, either by telephone or by email and in the event that the Customer /The User has paid the Product’s value prior to this information, let’s return the Product’s value to the bank account indicated by the Client, within a maximum of 14 days from the date on which the Company became aware of this fact or from the date on which the Client/User expressly expressed the intention to withdraw from the Distance Contract.
8. The Seller reserves the right to establish a minimum value threshold of the Order, for which the delivery of the Product/Products is free.
9. Art For Awakening s.r.l. reserves the right to cancel Orders for Products that are displayed on f-aurea.com as a result of technical errors or that, due to technical errors, present obviously erroneous/derisory prices for the Products.
10. F-Aurea.com will notify the Client/User by email regarding the status of the Order (i.e. initiation and collection of the Order, sending and picking up the package, etc.).
11. Due to the very short processing time of the Orders, it is impossible to make changes to the Orders already placed. The cancellation of the Order can be done within a maximum of one hour from its placement.
12. By placing the Order, the Customer and/or User certifies that he has reached the age of 18.

5.5.2 Placing the Order

1. The availability of a Product will be displayed in f-aurea.com as follows:

a. “in stock” – f-aurea.com’s stock includes more than 3 pieces of the respective Product;
b. “finished” – The product is no longer available in the f-aurea.com stock;

2. Within f-aurea.com, the Customer/User places the Order in the following way:

a. The Customer adds the selected Product(s) to the Shopping Basket and then goes to the Order form;
b. The Customer confirms in the Order form the compliance of the data necessary to conclude and execute the object of the Distance Contract. The user must complete the individual Order form with his data, necessary for the conclusion and execution of the object of the Distance Contract. In every situation, the transmission by the Client/User of some non-updated/incorrect data may lead to the impossibility of realizing the object of the Distance Contract. In the Order form it is necessary to specify the following data of the Client/User: name and surname, address (street, house/apartment number, postal code, town, country), e-mail address, contact telephone number, as well as and the data related to the Distance Contract, respectively the Product/Products, the quantity of the Product/Products, in case of availability, the model, color and size of the Product, the place and method of delivery of the Product/Products, the chosen payment method.
c. The Customer/User chooses one of the delivery methods made available by the Seller, as well as the method of payment of the Price and any costs generated by the delivery of the Product/Products;
d. The Customer sends the Seller the Order, submitting the offer to purchase the Product, through the functionality provided by f-aurea.com for this purpose (i.e. the “Place Order” button). When placing the Order by the Client/User, acceptance of the f-aurea.com Terms and Conditions is required;
e. during the placing of the Order, until pressing the “Place Order” button, the Customer/User has the possibility to review the Shopping Basket, in the sense of adding/removing Products or changing their quantity, changing the billing and delivery addresses , as well as the method of delivery and payment.
f. depending on the payment method chosen, the Client/User may be redirected to a page of an external provider, which provides payment services for the purpose of paying the Price.

3. The Seller, in response to the Order placed by the Customer/User, will send the Customer/User an automatic message to the e-mail address provided by the Customer/User, through which it will confirm the receipt of the Order and the start of the Product availability check. The automatic message will be sent to the Client/User only after f-aurea.com has received from the payment processor the confirmation of the Transaction.
4. In the event that the Seller, due to the lack of availability of the Product, ascertained as a result of the verification of the Order placed by the Customer/User, cannot honor it with regard to the Product ordered/all the Products ordered, the Customer/User has the right to cancel the entire Order (in respect of all offers). Cancellation of the Order by the Customer/User releases the Seller from the obligation to fulfill it.
5. The Order receives a number and all purchase offers regarding the Products listed in the Order will be processed in parallel.
6. By completing the Order, the Customer/User expressly declares that he agrees that a f-aurea.com representative will contact him by any available means (i.e. e-mail/telephone) to confirm the Order.

5.5.3 Conclusion of the Distance Contract

1. The Distance Contract is considered to have been concluded when the Seller confirms by email the placing of the Order by the Customer/User and the availability of the Product/Products, by accepting his offer regarding the purchase of the Product/Products mentioned in the Order.
2. The Distance Contract specifically names the Product, its main characteristics, the Price, shipping costs and other relevant conditions, its content being supplemented with the f-aurea.com Terms and Conditions.
3. The Seller endeavors to ensure the availability of all Products and to realize the object of the Distance Contract. If the delivery of the Products is not possible for reasons independent of f-aurea.com, the Customer/User has the right to the resolution of the Distance Contract and the return of all amounts paid, as the case may be. The Client/User cannot request the payment of moral damages.

6 PAYMENT METHODS AND TERMS FOR PRODUCTS PURCHASED WITHIN F-AUREA.COM. BILLING

6.1. Methods and Terms of Payment for Products Purchased within f-aurea.com

1. The Seller makes available to the Customer/User the following payment methods:

6.1.1 General provisions
a. payment with payment cards through authorized services, within f-aurea.com.
b. Payment by bank account. Then: Shipping or download is available after payment has been verified by Art For Awakening s.r.l. staff.

2. Current payment methods are specified within f-aurea.com in the Shopping Basket, “Payment Details” section
3. The Customer/User’s payment card data will not be accessible to Art For Awakening s.r.l. nor will it be stored by the Company or by the payment processor integrated in the www.f-aurea.com platform, but only by the authorization institution of the Transaction or by another entity authorized to provide data storage services for the identification of the card used by the Client/User to complete the Transaction, about whose identity the Client/User will be informed, prior to entering the data.
4. Within f-aurea.com, the entity authorized to provide payment processing services is Banca Transilvania S.A.
5. For Transaction security reasons, the Client/User is advised not to stay logged in on www.f-aurea.com and not to set the automatic login option on mobile devices. Disclosing the password to the Account is not allowed and it is recommended to use a password with a strong security character (eg: to contain at least eight characters, including uppercase letters, lowercase letters, numbers and special characters).

6.2. billing
1. The price, payment method and payment term are specified in the Order. The Seller will issue to the Customer a tax invoice for the Products delivered according to the Order, the obligation of the Customer/User being to correctly and completely specify all the information necessary for the Seller to issue the tax invoice, in accordance with the legislation in force.
2. By sending the Order, the Client/User expresses his agreement to receive the tax invoices in electronic format, by adding them by f-aurea.com to the Client’s Account or via electronic mail, to the e-mail address mentioned by the Client/User .
3. The tax invoices issued by the Seller for the Products related to some Orders that will be delivered by courier will be sent to the Customer/User by email. Invoices related to the Product/Products that have not been picked up by the Customer/User will be canceled by the Seller at the time when the Product/Products will be returned by the Courier.

7 TRANSPORTATION METHODS AND COSTS. DELIVERY TERMS AND CONDITIONS. RECEPTION OF PRODUCTS

7.1 Transport Methods and Costs

1. A download link is provided for downloadable products. In the following conditions:
a. Download is available when payment is verified and received.
2. Download the courses in video format is available starting from the time and date indicated for the launch of the course.
3. Webinars are shared at the time, time and date they are made available by Art For Awakening s.r.l. staff. If the client is unable to participate for any reason, including lack of web connection, non-participation is not attributable to Art For Awakening s.r.l. and its staff.

7.1.3 Transportation Costs
1. General Provisions

1. Transport costs for the delivery of the Products are the responsibility of the Customer/User, unless the Distance Selling Agreement provides otherwise.
2. The costs of the delivery of the Product are indicated on the pages of the www.f-aurea.com platform in the “Delivery costs” section and at the time of placing the Order by the Customer/User.

7.2 Terms and Conditions of Delivery. Reception of Products

7.2.1 Delivery Terms

1. The total waiting time regarding the delivery of the Product to the Customer/User (delivery date) consists of the time of preparation of the Order for shipment by the Seller and the time of delivery of the Product by the Courier/personal pickup from Pick Up Points.
2. The estimated delivery date may vary depending on the Product and/or delivery method chosen.
3. The company will undertake all necessary actions to deliver the ordered Products within 30 calendar days from the conclusion of the Distance Contract.
4. If the Products have not been delivered within the indicated period, the Customer/User may request delivery within an additional period of 5 Working Days. If the Products are not delivered even within the additional term, the Customer/User may request the resolution of the Distance Contract.
5. If the Products are unavailable (including if the Price or some characteristics of the Products have undergone changes, after the Company confirms the Order, f-aurea.com will inform the Client/User about the unavailability, and the amounts he paid will be refunded to the Client/User within 14 calendar days from the date of the respective notification, if the Client/User has paid them in advance. , and f-aurea.com will deliver the Products according to the Order thus modified by the Customer/User.

6. It is possibile that some items in the same order will be split in more than one shiping. The exact number of parcel will be communicated by email from Art For Awakening s.r.l. staff to the Client.

7.2.2. Delivery Conditions
1. In the case of Orders with personal pickup, it is necessary for the person who will pick up the package to present an identity card of the Customer/User at the chosen adress.
2. It is possibile that the Customer/User will be contacted by phone by the Courier to obtain confirmation of his presence at the address chosen for the delivery of the Order.
3. The Customer/User undertakes to be present at the indicated delivery address, during the time interval in which the Courier informs him that he is delivering the Order, otherwise he will bear the transport fee related to a possible new delivery. The time interval in which the Order is delivered can only be changed with the Courier’s consent.
4. It may be possibile that the couries will ask the customer to identify himself\herself, providing proof of his identity and communicate the Order number assigned by the Seller.
5. If the Customer/User is unable to receive the Order in person, the Order will be left at the specified address only to a person over the age of 18 and only in the case of prior notification of the Order number to the Courier.
6. No order delivery request will be honored if the Customer/User does not meet the above conditions.
7. In the case of delivery to the Customer’s/User’s place of work, if the Courier cannot have access to the building, the Customer/User must ensure that he can receive the Order.
8. Delivery is considered to be completed by Art for Awakening s.r.l. at the time of handing over the Ordered Products to the Customer/User.

7.2.3 Reception of Products

General aspects
1. The Customer/User is obliged to sign the delivery note presented by the Courier upon delivery of the ordered Products, to which is attached the delivery note containing all the information about the delivered Products (product name, quantity, price). The Customer/User will also check whether the Products are damaged or missing, and any problems will be noted on the delivery note, so that they can be taken into account.

8 WARRANTY OF PRODUCTS AND COMPLAINTS REGARDING PRODUCTS

8.1 Product Warranty

1. The guarantee represents any commitment assumed by the Seller towards the Customer/User by which he undertakes to return to the Customer/User, without the request of additional costs, the Price paid, the repair price or the replacement price of the Product, if it does not correspond to the stated conditions in F-Aurea.com or in the declaration of conformity of the Product.
2. The products displayed on F-Aurea.com may be subject to the manufacturer’s or distributor’s warranty. The detailed terms and conditions of the warranty, as well as its duration, are presented on the warranty document issued by the manufacturer or distributor and which accompanies the Product, as the case may be.

3. The product is guaranteed under the following conditions:

1. The Customer/User purchased the Product from F-Aurea.com;
2. The Customer/User has complied with the instructions for use and maintenance of the Product, it being used according to the instructions imposed by the manufacturer or distributor;

3. The Customer/User has kept the warranty certificate and the fiscal document (i.e. invoice or fiscal receipt) certifying the purchase of the Product. The place of presentation in order to benefit from the guarantee is the one specified on the guarantee certificate, which accompanies the delivered Product.
4. Causes of loss of warranty:

1. breakdowns/mechanical damage to the Product, excessive exposure to solar radiation of the Product or unauthorized physical changes to it;
2. the failure of the Product, caused by non-compliance with the instructions for its use, maintenance, transport, handling and installation, provided in the user manual;
3. mechanical damage caused by hitting the Product or damage to the marking with its model and series;
4. flooding, burning, exposure to the sun or electric discharges of the Product, improper modifications or installations, unauthorized interventions;
5. destruction of the internal circuits of the product, generated by the shocks resulting from its improper handling.

5. F-Aurea.com does not offer a commercial guarantee for the Products delivered to Customers/Users.

8.2 Complaints about Products

1. The images of the Products from f-aurea.com are only illustrative and do not constitute a mandatory presentation of the Product’s property (i.e. the packaging may differ, depending on the changes made by the manufacturer or distributor).
2. The Seller is obliged to deliver to the Customer/User Products without defects and which are in accordance with the Distance Contract.
3. It is considered that the products are in accordance with the Distance Contract, if:

1. Corresponds to the description made by f-aurea.com;
2. Correspond to the purposes for which products of the same type are normally used.
3. It presents the parameters of quality and normal performance, which the Client/User can reasonably expect, given the nature of the Product, the statements of the Product regarding its specific characteristics made through advertising or by inscription on the Product label.
4. In the event that the Products present a defect upon delivery, the parties of the Distance Contract may agree on a compensation for the Seller to grant to the Customer/User, in the form of a voucher.
5. The complaint can be submitted by the Customer/User either in writing, to the address in Frumuseni 276, Arad 317122, or by email at info@f-aurea.com Also, Art For Awakening s.r.l. recommends the Client/User to mention in the complaint information regarding (i) the circumstances that are the subject of the complaint, more precisely the type of defect in the Product and the date of its discovery; (ii) the method chosen to bring the Product into compliance with the Distance Contract or the declaration regarding the reduction of the Price or the waiver of the Distance Contract, as well as (iii) the petitioner’s contact details.
6. If the Product sold has a defect, the Customer/User has the right to request the replacement of the Product with a defect-free one or the elimination of the defect, in the form of replacement or repair of the Product. If replacing the Product or eliminating its defect is impossible for the Seller, the Customer/User may request a reduction in the Product Price or, if the defect is substantial, may withdraw from the Distance Contract.
7. To the extent that the complaint made by the Customer/User is justified, the Seller has the following obligations:

1. if the replacement or repair of the Product is possible, to replace the defective Product with one without defects or to remove the defect in a reasonable time, without creating unjustified inconvenience for the Customer/User, in accordance with the provisions of Incidental Legislation and at his expense. Any repair or replacement will be made within a reasonable period of time established by mutual agreement between the Seller and the Customer/User;
2. if the replacement or repair of the Product is not possible, to refund the Customer/User the Price, partially or fully, depending on the Customer/User’s request, within 15 calendar days from the date on which the Seller is notified of this by the Customer /User. In order to reimburse the Price and complete the Transaction, the Company will return the respective amount to the bank account in Euro, provided by the Client/User.

8. The Seller will respond to the Customer/User’s complaint request through the CS Department, no later than 10 Working Days from the date of its receipt. The Company will inform the Client/User about the progress of the complaint, especially about its receipt, acceptance or rejection, by email/telephone.
9. In the event that, in order to comply with the claim submitted by the Customer/User or to fulfill the Warranty, it will be necessary to make the Product available to the Seller, the Customer/User will be obliged to deliver the Product at the Seller’s expense.
10. The duration of the settlement of the complaint, including the elimination of defects or the replacement of the Product, usually lasts up to 30 calendar days, but the Client/User must provide the necessary assistance in order to meet the respective deadline.
11. The Seller is liable if the physical defect is detected by the Customer/User within two years from the date of delivery of the Product or before the expiry date mentioned on the Product packaging. The request to remove the defect of the Product or to exchange it with another Product without defects must be made within the aforementioned term, under the penalty of its prescription.
12. The Client/User must inform the Seller about the lack of conformity of the Product within two months from the date on which he found it, but no later than two years from the date of conclusion of the Distance Contract.

9 PROMOTIONAL CAMPAIGNS

9.1. General provisions
1. Through f-aurea.com, Art For Awakening s.r.l. offers its Customers/Users various discounts, gifts or vouchers, the use of which is subject to certain rules, communicated by the Seller in the form of regulations.
2. Unless otherwise stated, each discount or gift voucher can be used only once within the same Order, and cannot be combined.

9.2.1 Promotional Codes
1. Promotional codes offered by f-aurea.com within any Promotional Campaign are valid exclusively for the section mentioned in the e-mail transmitting the code or in the Promotional Campaign regulations, unless otherwise specified.
2. Promotional codes can be used exclusively at the time of placing the Order within f-aurea.com, and cannot be used to reduce the value of the Order after it has been placed.
3. For eligibility to a Promotional Campaign, the value of the transport is not taken into account, unless otherwise specified. Promotional Campaigns that have as their object free or reduced shipping costs are applied for each delivery.
4. If a promotional code was applied to an Order that could not be honored or was canceled for any reason, the Customer/User has the right to request the reactivation of the respective promotional code, exclusively in writing, through a e-mail to info@f-aurea.com, specifying the Order number, its status, the Customer’s name and the promotional code. They are reactivated for a maximum period of 30 calendar days.
5. Promotions on f-aurea.com are not cumulative. This is valid for any form of discount (loyalty cards, promotional codes, gift vouchers, percentage discounts on www.f-aurea.com, etc.) as a rule, except when it is stated otherwise in the Promotional Campaign. Certain Promotional Campaigns are not cumulative with other discounts, promotions or loyalty actions, this being specified in the regulations of the respective campaign.
6. f-aurea.com establishes unilaterally the regulations of the Promotional Campaigns. The benefits of Promotional Campaigns are applied to Orders that fully comply with the rules displayed on f-aurea.com, during the clearly stated validity period and within the limit of available stock. f-aurea.com does not guarantee the availability of the Products in stock for the entire promotional period.

9.2.2 Vouchers/coupons/promotional codes
1. General provisions

1. The voucher is an electronic document consisting of a promotional code or coupon or a code, of a certain value, specified in the promotional code or coupon and used to purchase a Product at a price reduced by the value of the respective voucher.
2. Each voucher is identified by a voucher code and has various requirements to be valid and applicable. The Customer/User is responsible for carefully checking all details and information on the voucher so that the discount can be granted.
3. Transport and handling fees are applied to the purchased Product, as the case may be, if the Promotional Campaigns and regulations do not provide otherwise. Thus, if a voucher, in order to be applicable, imposes a certain minimum purchase value of some Products, the transport, handling, etc. fees also apply to these Products, as the case may be. A voucher cannot be used to pay for taxes, delivery charges or other services, unless otherwise agreed.
4. Any gift product, regardless of the promotion, will have a minimum value, and the Customer/User will pay the tax to which he is obliged by law depending on the promotion, as the case may be.
5. Vouchers are only valid if they are used within f-aurea.com
6. Vouchers prohibited by law will be considered void. Vouchers are not intended for resale and cannot be converted into money.
7. All the provisions related to fraud, mentioned in these f-aurea.com Terms and Conditions, are fully applicable in terms of fraud related to vouchers, and the attempted fraud will be brought to the attention of the competent authorities.

2. Conditions of application

1. Any Promotional Campaign to which discount vouchers are applied is limited to one voucher per individual or legal entity, identified as Customer/User.
2. Each voucher is limited to one use and is valid for a limited period of time, as will be mentioned in the e-mail offering the voucher or as specified in each Promotional Campaign/offer separately. f-aurea.com reserves the right to modify or cancel these vouchers at any time, with prior notice to Customers/Users.
3. No voucher can be applied to other promotions/offers except those strictly mentioned in the respective offer.
4. The Voucher applies only to the Products/Product categories expressly mentioned as eligible in the Promotional Campaign. The products that are excluded from the Promotional Campaigns are communicated in the related regulations or in the terms and conditions of the special offers. These exceptions generally include Products that cannot be discounted by law.
5. In the case of Orders containing several Products, the value of the discount voucher will be allocated according to the provisions of each Promotional Campaign.
6. Any voucher will be valid starting from the date of its application, as a discount on the Order already made. A voucher cannot be applied to an Order already placed.
7. If an Order to which a voucher discount has been applied and contains several Products is cancelled, rejected or partially returned, the discount granted by applying the voucher cannot be applied to the other Products remaining in the Order, if the value of the Order does not comply with the Campaign conditions Promotional. f-aurea.com will not refund the value allocated from the voucher for canceled, rejected or returned Products that are part of an Order with multiple products. The amount paid for the Products will be refunded to the Customer/User.

9.2.3 Interruption or Withdrawal of the Promotional Campaign
1. In the case of a Promotional Campaign organized within f-aurea.com, the Company, as the organizer, reserves the right to interrupt or withdraw the Promotional Campaign at any time during its development, with prior information to the Consumers through appropriate means of communication (display on the f-aurea.com platform).
2. The organizer reserves the right to modify any of the conditions established in the respective Promotional Campaign regulations, during its implementation, for valid reasons, but not before notifying the public about these modifications.

9.2.4 Promotional Campaigns with gift product
Any promotion where a gift product is offered is limited to one gift product offered during the Promotional Campaign period per natural or legal person (identified as Customer/User), regardless of the number of Orders registered by a natural or legal person during the period The Promotional Campaign is ongoing.
In the event that there are identified fraud situations, f-aurea.com reserves the right to suspend the accounts thus created and to withdraw the benefits related to ongoing promotions or offers, to cancel Orders without notice, notification, other formalities or compensation.
Likewise, if an Order for which a gift product was offered is rejected or returned in full, the Customer/User is obliged to return the gift Product in its original, undamaged and unsealed condition.

10 WITHDRAWAL FROM THE DISTANCE CONTRACT. POLICY RETURN

10.1 Withdrawal from the Distance Contract

10.1.1 General Provisions

1. The Client/User has the right to withdraw from the Distance Contract, without specifying the reasons and without incurring any kind of expenses, other than those provided by law. In order to exercise the right of withdrawal within the term stipulated by the Incidental Legislation, the Client/User must inform the Seller of the right to withdraw using an unequivocal statement, which can be sent directly to the Contact details (Click here) and by e-mail at: info@f-aurea.com
2. The withdrawal period from the Distance Contract is 30 days and starts from the date on which the Product was taken over by the Customer/User or by a third party designated by him, other than the Courier, and in the case of a Distance Contract which includes several Products that are delivered separately, in lots or parts, from the entry into possession of the last Product lot or part.
3. The Seller has the obligation to notify the Customer/User of the confirmation of receipt of the withdrawal, and within no more than 14 calendar days from the receipt from the Customer/User of the declaration of termination of the Distance Contract, shall, in principle, return all payments made by him, including the delivery costs of the Product (with the exception of additional costs resulting from the delivery method chosen by the Client/User, other than the standard one, available in f-aurea.com). In the event that the Order contains several Products, but the Customer/User only returns one, f-aurea.com will not reimburse him for the delivery cost.
4. The Customer/User is responsible for any diminution in the value of the Products, as a consequence of handling them in a way other than what is necessary to become familiar with the nature, properties and functionality of the Product. For clarity, the Seller will withhold an amount of money representing the decrease in the value of the Product, which varies between 10% and 60% of the initial value of the Product, as the case may be, according to the table here.
5. The Seller will return the Price using the same payment method that the Customer/User used, as follows:

1. for Orders paid by bank card, by refund to the account from which the payment was made;
2. for Orders paid by bank account by returning the amount to the bank account sent by the Customer/User, which must be expressed in EURO. In the event that the Order is paid with the Revolut card, the refund of the amount in question is made to the respective card account.

6. The Customer/User has the immediate obligation, but not later than 14 calendar days from the date on which he informed the Seller of the withdrawal from the Distance Contract, to return the Product to the Seller or make it available to the person entitled by the Seller to take over. To comply with the deadline, it is sufficient to return the Product before its expiration, at the Seller’s Warehouse located in Frumuseni 276, Arad 317122, Romania, otherwise the Company reserves the right to delay reimbursement of the Product’s value until proof is received that it has been shipped.
7. For certain Promotional Campaigns, the Seller reserves the right to establish a different term for the Consumer to exercise the right of withdrawal, but in compliance with the minimum legal term of 14 days provided by the Incidental Legislation, the specific term for exercising the right of withdrawal following to be mentioned in each Promotional Campaign regulation, if applicable.

10.1.2 Exceptions to the right of withdrawal from the Distance Contract

1. The consumer cannot exercise the right of withdrawal for the supply of sealed Products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer: nutritional products, cosmetic products, underwear products, electronic products that came into contact with the skin/hair/oral cavity (for reasons of hygiene, they are accepted for return only after bringing them into compliance by replacing the elements that came into contact with the skin/hair/oral cavity).
2. For clarity, according to the provisions of art. 16 of the Government’s Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts, the following are exempted from the right of withdrawal from the distance contract:

1. service contracts, after the full performance of the services, if the execution has started with the express prior consent of the client and after he has confirmed that he has become aware of the fact that he will lose his right of withdrawal after the full execution of the contract by seller;
2. the provision of products and/or services whose price depends on fluctuations in the financial market that the seller cannot control and that may occur during the withdrawal period;
3. providing products made according to the specifications presented by the buyer or clearly customized;
4. providing products that are likely to deteriorate or expire quickly;
5. supply of sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the buyer;
6. the supply of products that are, after delivery, according to their nature, inseparably mixed with other elements;
7. the supply of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, the delivery of which cannot be made before 30 (thirty) days and the actual value of which depends on market fluctuations that the Seller cannot control ;
8. contracts where the customer has specifically requested the seller to move to his home to carry out urgent repair or maintenance work. If, on the occasion of such a visit, the seller provides services other than those expressly requested by the buyer or supplies products other than the spare parts indispensable for the execution of maintenance or repair work, the right of withdrawal applies to those additional services or products ;
9. providing sealed audio or video recordings or sealed computer programs that have been unsealed after delivery;
10. the supply of newspapers, periodicals and magazines, with the exception of subscription contracts for the supply of such publications;
11. the provision of digital content that is not delivered on a physical medium, if the provision has begun with the prior express consent of the client and after he has confirmed that he has become aware of the fact that he will lose his right of withdrawal. 10.2 Return Policy

11.2.1 General aspects
1. f-aurea.com offers free returns for Customers/Users who notify their intention to withdraw from the Distance Contract, within the term mentioned above in section 10.1.1, except for express provisions to the contrary mentioned in the Terms and Conditions for certain categories of Products, as the case.
2. the return costs are always honored by the Customer/User. The products can be returned by any courier company that ensures the delivery of the return parcel to the Seller’s Deposit, located in Frumuseni 276, Arad 317122, Romania.

11.2.2 Terms and Conditions for Returning Products
1. The Customer/User undertakes to notify f-aurea.com of his intention to return the purchased Products, either by e-mail to the address info@f-aurea.com, or through the online returns facility found in the Customer account, within a maximum of 30 calendar days after receiving the Products. Otherwise, f-aurea.com can refuse the parcel.
2. The necessary information that must be provided to f-aurea.com for sending the courier is as follows:

1. date of dispatch of the package;
2. order number;
3. the amount to be returned;
4. the address from where the Courier is to pick up the return package;
5. bank account data.
4. Upon receiving the information regarding the Customer/User’s return intention, Art For awakening s.r.l. makes a request to the Courier and sends it to the address indicated by the Customer/User, in order to pick up the parcel to be returned. The transport costs of the returned parcel/parcels are not the responsibility of the Customer/User, they will be assumed by Art For Awakening s.r.l.

10.2.3 Conditions for returning products

10.2.3.1. General provisions
1. In any situation of returning the Products, they must be in the same condition in which they were sent to the Customer/User, together with all the accessories and documents that accompanied the respective Product (i.e. invoice, warranty certificate, power cables, etc. .).
2. The products must be returned in the same condition in which they were received by the Customer/User, i.e. without defects (except for hidden defects and except for defects already previously reported by the Customer/User in correspondence with the CS Department).
3. In accordance with the applicable legal provisions, f-aurea.com reserves the right not to accept the return of the following products:

1. likely to deteriorate or expire quickly;
2. sealed, which cannot be returned for health protection or hygiene reasons and which have been unsealed by the consumer;
3. which, after delivery, according to their nature, are inseparably mixed with other such elements;
4. which do not have a sprayer, from the Perfumes category;
5. for food use.
4. On each Product page there is information regarding the possibility of it being returned by the Customer/User. Products that constitute a set must be returned as a set.
5. If an Order, in which one or more Gift Products were offered, is returned in full, the Customer/User is obliged to return the Gift Product in its original state, respectively undamaged and with sealed packaging. The conditions of the Promotional Campaigns carried out by f-aurea.com are presented in section 9 of the f-aurea.com Terms and Conditions. In the event that the Gift Product is not returned, the value of the return will be reduced accordingly by the value of the Gift Product.

10.2.3.2. Special Situations and Exceptions for Return

Category “Books”
1. Books must not have bent corners, damaged spines, stains on the cover or pages, or torn pages.

Category “Cards”

1. Metal cards must not have any scratch on the image displayed, cause they are artistic cards and scratch will damage the artistic value.
Category “CD”

1. CD must have the cover and the box intact and not damaged or scratched.

Category “Herbal Supplement”

1. Herbal supplement will not be accepted for return, in accordance with applicable legal provisions.

Category “Clothing”
1. Underwear, swimwear, gloves, scarves and stockings cannot be returned.
Category “Cosmetics”
1. Personal care products will not be accepted for return, in accordance with applicable legal provisions.

Category “Massage Oils”
1. Personal care products will not be accepted for return, in accordance with applicable legal provisions.
Category “Electronics”
General conditions
1. The Customer/User can return the Products within 30 calendar days from the moment they were delivered to him via the courier.
2. In this sense, the Customer/User is obliged to complete the return form and send it to f-aurea.com no later than the 30th calendar day from the date of delivery by the Courier or of picking up the Product from the Pick Up Point/Center Post Collect where the Customer/User has requested it to be delivered to them. Requests made after the deadline indicated above will not have any legal effect.
3. All products that the Customer/User returns must be in the same condition in which they were received, accompanied by the original, intact labels, the original warranty certificate, as appropriate, as well as all other documents that have accompanied Product delivered.
4. If the Customer/User has purchased several products of the same kind and chooses to return them all, only one of the Products can be unsealed.
5. f-aurea.com does not accept returns regarding Products that have at least one of the following characteristics:

1. unauthorized interventions were carried out on the Product;
2. have damaged or incomplete packaging;
3. have traces of wear or excessive use;
4. have scratches, chips, bumps or signs of exposure to mechanical/electrical shocks;
5. they do not have all the accessories received in the package in which they were delivered;
6. The product was part of a special order (the special order is that which concerns a product that is not part of the usual stock of the Supplier, but which can be delivered on the basis of a firm order and the payment of an advance by the Customer/User ;
7. meet one of the specific conditions, depending on the type of product.

8. f-aurea.com recommends to the Customer/User that the Products in this category be returned sealed. If the respective Products have been unsealed, they can only be returned if they have not been installed/mounted or used.

Category “Art”
General conditions
1. In accordance with this Policy, the products purchased from f-aurea.com can be returned within 30 days from the date they were picked up.
2. The customer can return the products, meaning that he will complete the withdrawal form, which can be accessed here. In order to complete it, it is not necessary to be registered as a customer of Art For Awakening s.r.l.
3. The provisions of this Policy do not in any way limit the rights guaranteed to the client based on:

(a) Law no. 449/2003 on the sale of products and associated guarantees – for products that are covered by the guarantee – for non-conformity of the products
(b) guarantees – for products covered by the guarantee, for quality defects
(c) the right to withdraw the sales contract as a result of Emergency Ordinance 34/2014 on consumer rights, under the effects of contracts concluded with professionals.

10.3 Return terms and conditions

1. f-aurea.com will accept as return products that:

a) they are in the original packaging (unopened) and are not damaged or show signs of wear, respectively in the condition in which they were delivered to the Customer with the exception stated before;
b) they are not in their original packaging (this category also includes products that are returned in their original packaging, but it is opened) and only show signs of handling, necessary to establish the nature, characteristics and functionality of the products when they were unpacked and assembled. The customer thus has the opportunity to see and test the goods at home, without using them.

2. f-aurea.com will refund the value of the previously mentioned goods, in the following way:

a) If the products are not used and are in the original packaging, as provided in section 10.3.1.a above, the return can be made within 30 days from the date on which the goods were purchased, delivered or picked up.
b) in the case of the products referred to in section 10.3.1.b above:
i. the return can be made within 14 days from the date on which the products were purchased, delivered or picked up.
ii. the return can be made within a maximum of 30 days from the date on which the goods were purchased, delivered or picked up.

f-aurea.com reserves the right not to refund the value of goods that do not comply with the provisions of the section.

3 If the products are dirty, damaged, scratched, chipped, show signs of washing or other damage. The consumer is only responsible for the diminution in value of the products resulting from their handling, other than what is necessary to determine the nature, characteristics and functioning of the products. The decrease in the value of the products must not be a disincentive for the consumer to exercise his right of withdrawal. However, if the decision is made to accept the return of these products, f-aurea.com reserves the right to reduce the refunded amount, in a manner that reflects the reduction in the value of the products. The amount reimbursed will be determined according to the period of time in which the returned product was used, as well as the wear of the product. The amount of the refund will decrease the longer the product has been used and the signs of product wear are obvious, so the amount of the refund is the lowest.

10.4 f-aurea.com will not refund the value of the following products:
1. Textiles (bath or kitchen towels, robes, sheets and bed linens, pillowcases, pillows, quilts, blankets, beds) – considering the provisions of art. 16 lit. e) from Emergency Ordinance no. 34/2014 regarding consumer rights in contracts concluded with professionals, for health protection and hygiene reasons, if the product packaging is missing and the products show signs of wear/use/damage, they will not be reimbursed.
3. Light bulbs – are considered products liable to deteriorate quickly, so they cannot be reimbursed considering the provisions of art. 16 lit. d) from Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals
4. Detergents / Cleaning solutions – they are considered products susceptible to rapid deterioration, so that these could not be reimbursed considering the provisions of art. 16 lit. d) from Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals

10.5 Reimbursement of costs incurred by the Customer/User in connection with the purchase of returned Products
1. For returns fully accepted by f-aurea.com, the Customer/User will be reimbursed, within 14 calendar days from the date on which f-aurea.com is informed by the Customer/User of his decision to return The products, the price of the returned products, as well as the cost of the initially paid/return shipping. The exception is orders made based on a voucher, for which the user will receive another discount code with the same value. If the value of the customer’s order exceeds the value of the voucher, the difference will be returned to the customer.
2. The amounts in question will be returned as follows:

a. for Orders paid by online card, by refund to the account from which the payment was made;
b. for Orders paid by Bank card, by bank transfer.

11 INTELLECTUAL PROPERTY.

The exclusive rights to the product made available/displayed through f-aurea.com by the Seller, in particular the copyright, the F-Aurea name and logo (trademark), its graphic elements, as well as the rights to the databases are subject to legal protection and are the property of the Seller or its suppliers/contractual partners. The Client/User has the right to use the above Content, free of charge, but only for personal use and exclusively for the correct use of f-aurea.com.

11.1 EXCEPTIONS

Musical product, CD, Audio Files, and some Video Files, can have additional rights, as stated in the product page.

11.2. NO RESALE OF SERVICES PERMITTED.

Customers agrees not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Courses or Online Webinars (including courses materials). This agreement is not transferrable or assignable with Art For Awakening s.r.l. without Art For Awakening s.r.l. prior written consent.

11.3. NO TRANSFER OF INTELLECTUAL PROPERTY OF NAMES VIDEOS AND MATERIAL OF COURSES AND ONLINE WEBINARS.

1. Art For Awakening s.r.l. copyrighted and original materials provided to the customers thorught the courses and online webinars purchased from f-aurea,com shop shall be provided to the Customer for his/her individual use only and a single-user license.

2. Client shall not be authorized to use any of Art For Awakening s.r.l. intellectual property for Customer business purposes. Customer shall not be authorized to share, copy, distribute, or otherwise disseminate any materials received from Art For Awakening s.r.l. electronically or otherwise without the prior written consent of Art For Awakening s.r.l. All intellectual property, including Art For Awakening s.r.l. copyrighted course materials, shall remain the sole property of Art For Awakening s.r.l. No license to sell or distribute Company’s materials is granted or implied. This includes but is not limited to the terms: Ignis Rebirth, F-Aurea, F-Aurea Group, F-Aurea.com, F-Aurea Holfrattale etheric information field, F-Aurea informational field, Ricalibrazione Planetaria, Planet Recalibration Practice, F-Aurea Fields, F-Aurea Etheric Fields, F-Aurea Tradiction, F-Aurea Etheric Forces.

This does not include concepts and ideas, but only material documents, and program videos.

11.4 NON COMMERCIAL RIGHTS TO SHARING IDEAS AND PARADIGMS

1 The concepts and ideas shared throght f-aurea.com, books, classes and online webinars, selled on f-aurea.com shop, or otherwise present in f-aurea.com website are to be considered a heritage of humanity, and falls under Creative Commons License 4.0. Attribution-NonCommercial 4.0 International (“CC BY-NC 4.0”). This not cover the phisical material such as videos, PDF, books and ebooks, but cover only the ideas, paradigms, and other philosophical aspects found on those materials.

2. Creative Commons License 4.0. (“CC BY-NC 4.0”) cover only the ideas and the concepts shared on f-aurea.com platform, books or ebooks sold at f-aurea.com shop, courses and online webinars purchased thorught f-aurea.com shop, and every material from the F-Aurea Group.

3. Creative Commons License 4.0. (“CC BY-NC 4.0”) permit the Customer at his\her own sole risk and responsability to share the IDEAS and PARADIGMS, and remix or include them in others works and classes, under the following terms: a) Attribution. Customer must give appropriate credit, provide a link to the license, and indicate if changes were made citing the source of the informations shared as F-Aurea.com or F-Aurea Group and Francesco Verticchio, Manlio Di Donato. Customer may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use. b) NonCommercial: Customer may not use the material for commercial purposes. c) No additional restrictions: Customer may not apply legal terms or technological measures that legally restrict others from doing anything the license permits. d) Accountability: The Customer will be the sole and only one accountable for damage that may be provided by the shared ideas.

11.5 LIMITATION OF LIABILITY.

By using Art For Awakening s.r.l. services buying courses and or online webinars, ebooks, books, and other materials, Customer releases Art For Awakening s.r.l. it officers, employers, directors, and related entities from any and all damages that may result from anything and everything. Courses and online webinars are only an educational/coaching service being provided. By using Art For Awakening s.r.l. services and enrolling in the Courses and Online Webinars found on f-aurea.com, Customer releases Company from any and all damages that may result from anything and everything. Customer accepts any and all risks, foreseeable or non foreseeable, arising from such transactions. Regardless of the previous paragraph, if Art For Awakening s.r.l. is found to be liable, Art For Awakening s.r.l. liability to Client or to any third party is limited to the lesser of (a) the total fees Customer paid to Art For Awakening s.r.l. in the one month prior to the action giving rise to the liability, and (b) € 1000. All claims against Art For Awakening s.r.l. must be lodged with the entity having jurisdiction within 100-day of the date of the first claim or otherwise be forfeited forever. Customer agrees that Art For Awakening s.r.l. will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Art For Awakening s.r.l. services or enrolment in the Courses and or Online Webinars. Customer agrees that use of Art For Awakening s.r.l. services is at Client’s own risk.

11.5.1

1. The use of any registered brand name of F-AUREA.COM, F-AUREA, Art For Awakening s.r.l. on other platform, social media, and such, shared by Customer or under the Creative Commons Non Commercial Licence, does not constitute an advertisement for the company.

2. The company does not assume responsibility and cannot be blamed for damages caused by using the Content of the www.f-aurea.com platform.

12 DISCLAIMER OF LIABILITY

1. Art For Awakening s.r.l. does not guarantee that the www.f-aurea.com platform, the servers on which it is hosted or the e-mails sent by f-aurea.com are free of viruses or other potentially harmful computer components, that they do not contain errors, omissions, malfunctions, delays or interruptions in operation or transmission, line drops or any other factors of similar disruptive effect. The Client/User uses the www.f-aurea.com platform at his own risk, the Company being exonerated from any liability for any direct or indirect damages caused by the use or access/visiting of f-aurea.com or as a result of using the information on the www.f-aurea.com platform . Art For Awakening s.r.l. is not responsible for errors or omissions that may occur in the drafting or presentation of materials on the website.
2. The seller does not assume responsibility for the descriptions of the Products presented on the www.f-aurea.com platform, these being made available to Art For Awakening s.r.l by the suppliers.
3. The information included in f-aurea.com is educational, philosophical, related to wellness, not as substitute of clinic and psichiatric cure. They are made available in good faith, from sources that the Seller considers reliable. And from our own internal research, that have no scientific claims, nor undergone clinical trials. If any of the published articles or any other information falls under Law no. 8 of 1996 regarding copyright and related rights, the Client/User is requested to bring this fact to the attention of the Seller at info@f-aurea.com, so that the necessary legal measures can be taken, if necessary.
4. The company, as the organizer of Promotional Campaigns, does not assume responsibility for code losses or unauthorized uses of the Promotional Campaign voucher in question, is not responsible for forged vouchers and reserves the right to cancel the voucher used for purchase or to reduce its value from the amount to be reimbursed, in the case of the return according to the law, of a product participating in the respective Promotional Campaign.
5. Any links to other sites are provided only for the purpose of increased accessibility of information, and f-aurea.com does not assume any responsibility or liability for the content of these sites, for the products or services promoted or marketed through these websites.
6. Art For Awakening s.r.l. is not responsible for any losses, costs, lawsuits, claims, expenses or other liabilities, if these are directly caused by non-compliance with the f-aurea.com Terms and Conditions.
7. The company is not responsible for the damages created as a result of the failure of the www.f-aurea.com platform, as well as for those resulting from the impossibility of accessing certain links published on the www.f-aurea.com platform.
8. In each case regarding the establishment of the liability of the Seller, its employees, authorized representatives and/or plenipotentiaries, the liability towards the Consumer, regardless of its legal basis, is limited to the value of the Distance Contract Price.

13 MAJOR FORCE

1. None of the parties to the Distance Contract is responsible for the non-execution on time – in whole or in part – of any obligation falling under the Distance Contract, if the non-execution of the respective obligation was caused by major force. For the purposes of this article, major force represents an event independent of the will of the parties, unpredictable and insurmountable, which is not due to their intention or fault, occurred after the entry into force of the Distance Contract and which prevents the contracting parties from executing, in whole or in part, their , the obligations assumed. Armed conflicts, social movements, fires, floods or any other natural calamities or restrictions arising as a result of a quarantine or an embargo are considered such events, the enumeration not having a limiting character, but an enunciative one. Labor disputes do not constitute force majeure. An event similar to the above which, without creating an impossibility of execution, makes the execution of the obligations of either party extremely expensive is not considered a case of major force.
2. The party invoking the major force event is obliged to notify the other party within 5 calendar days from the date of occurrence of the event and to provide the necessary evidence within this period. Also, the party that invoked major force is obliged to inform the other party about the termination of the case of major force. In the situation where the notification is not made, the party invoking the occurrence of the major force event will be liable for all the damages caused as a result of the omission of the notification regarding the occurrence/termination of the major force case.
3. If, within 15 (fifteen) days from the date of its occurrence, the respective major force event does not cease, each party to the Distance Contract will have the right to notify the other party of the full termination of the Distance Contract, without any from the parties to be able to claim damages from the other.

14. APPLICABLE LAW. RESOLUTION OF DISPUTES

14.1. Applicable law

1. The Distance Contract will be governed and interpreted in accordance with Romanian law.

14.2. Dispute Resolution

1. The parties to the Distance Contract will make every effort to amicably resolve any dispute arising from the conclusion and execution of the Distance Contract.
2. If this is not possible, the dispute will be submitted for resolution to the competent courts in Romania, without thereby restricting the Consumer’s right to resort to the alternative dispute resolution method, by accessing the portals http://ec.europa.eu/consumers/odr/ and/or www.anpc.ro.

15. FINAL PROVISIONS

15.1. General aspects

1. The nullity of any clause of the f-aurea.com Terms and Conditions, partial or complete, will not affect the validity of the other clauses or parts of clauses of the f-aurea.com Terms and Conditions. The inoperative or unmentioned clause will be replaced by a corresponding clause which, to the legally acceptable extent, comes closest to what was intended or, following the conception and expression of the f-aurea.com Terms and Conditions, what is intended is obtained after approval about the missing or inoperative clause.
2. The provisions of the Terms and Conditions of f-aurea.com are supplemented with the provisions of the Incidental Legislation.
3. The Distance Contract is concluded in Romanian. Confirmation to the Client/User of the provisions of the concluded Distance Contract is done by sending an e-mail to the Client/User confirming the registration of the placed Order.

15.2 Provisions for Legal Entities/Users

1. This point in the f-aurea.com Terms and Conditions and the provisions set out in this point refer only to customers/users who do not have the status of Consumer.
2. The Seller has the right to terminate the Distance Contract concluded with a non-consumer Customer/User within 14 calendar days from the date of conclusion. The cancellation of the Distance Contract in this case can be done without presenting the reasons and does not give reasons for the Customer/User to have claims against the Seller.
3. In the case of non-consumer Customers/Users, the Seller has the right to limit the available payment methods, including may request payment in advance, in full or in part, regardless of the payment method chosen by the Customer/User or the provisions of the Distance Contract .
4. When the Seller hands over the Product to the Courier, the Customer/non-consumer User assumes the benefits and responsibilities associated with the Product, as well as the risk of accidental loss or damage to the Product. The Seller in this case is not responsible for the loss, diminution or damage of the Product occurring from the time it is picked up for transport until it is handed over to the Customer/User or for delays due to transport.
5. Neither the Seller nor its employees, authorized representatives and agents are liable to the Client/User, its subcontractors, employees, authorized representatives and/or agents for any kind of damage, direct or indirect, unless the damage to was intentionally provoked by him.
6. In each case regarding the establishment of the liability of the Seller, its employees, authorized representatives and/or plenipotentiaries, the liability towards the non-consumer Customer/User, regardless of its legal basis, is limited to the value of the Distance Contract Price.
7. All disputes arising between the Seller and the Customer/non-consumer User will be submitted to a competent court in Romania.
